Terms of Service

Global Solutions™ International PTY LTD hereafter referred to as "hostshell.com" provides various hosting facilities and accounts. Hostshell.com has certain legal and ethical responsibilities regarding the use of its computer network and equipment involved in these services.

hostshell.com's general policy is to act as a neutral provider of access to the global Internet. hostshell.com reserves the right to suspend or cancel a customers access to any or all services provided by hostshell.com when hostshell.com decides that the account has been used inappropriately

General Policies

b) The customer is responsible for all denial of service attacks they may receive and must try their best to prevent such occurrences. If a customer is found to be receiving denial of service attacks frequently their account may be suspended or canceled at the discretion of hostshell.com management.

c) There is to be only one connection per process connecting to irc excluding ircd processes.

d) There are to be no IRC connections made from any main hostshell.com's server IP address or any other hostshell.com hostnames not listed in the vhost list. All connections to IRC must be made from our virtual hostnames.

e) We do not permit shoutcast servers, any type of game/mud servers, or any processes that consume a large amount of bandwidth and/or system resources to be run from hostshell.com servers, unless prior permission is sought.

f) Pornography and other material found to be explicit or offensive by hostshell.com staff is strictly prohibited.

g) Credit card fraud is illegal, and all fraudulent transactions when signing up are logged and sent to the relevant authorities.

h) No spamming or unsolicited mail which includes messages from IRC bots

i) If any processes exceed 3% of system resources it will be killed without any warning. If your processes exceed this limit more than 3 times in a month your account may be cancelled or suspended.

Shell Accounts
a) There are to be no war, xdcc, takeover, emech or abusive eggdrop bots run on hostshell.com's servers.

b) Eggdrop bots may only be run on servers that specifically allow them.

c) IRCD processes may not be run from our shells unless specified when signing up. You may modify your account under the 'members' section and purchase an IRCD account. Fee's must be paid before IRCD's are to be run.

d) Shell trading is strictly prohibited. If you are found doing so, your account will be deleted without refund.

e) Identd servers are run for all accounts. You CANNOT use an ident other than that of your login name.

f) No programs which are not installed on our servers in the 'menu' may be run without prior permission from staff.

IRCd Accounts
a) IRCd's may not exceed 200 concurrent users.

b) No server may be linked to any warez networks, pornography trading or any other trading which may be illegal.

c) IRCd accounts are limited to 5gb outgoing traffic per month.

d) No IRCd is to host spam bots, DDoS bots, evil bots or anything of that nature.

e) Wherever possible, please do not run port/socket scanners on your IRCd.

Webhosting
a) No trojaned or virus' are to be spread via our webservers

b) No bots or IRC connections may be executed from our webservers

c) No warez or any other images or software may be available from your site without permission sought from their author(s)

Domain Registration
hostshell.com is a reseller for the enom system. We will not be held responsible for overcharges, non registration of domain names or anything that is the responsibility of enom.com. All management, renewal and queries regarding domain registration should be forwarded to support@enom.com.

Email Accounts
a) No spam nor email sent without the permission of the receiving party to be sent

b) Unsolicited commercial advertisements are not allowed in e-mail, and will likely result in account suspension or cancellation. Commercial advertisements are unwelcome in most usenet discussion groups and on most e-mail mailing hostshell.com. Inappropriate posting may result in account suspension or cancellation. Spamming, or sending a message to many different off-topic newsgroups, is particularly unethical and will be treated as such.

Virtual Hosts and IP Addresses
IP addresses and Virtual hosts are available for purchase from hostshell.com. All hostnames and IP's are subject to approval from ARIN (American Registry of Internet Names/Numbers) or APNIC (Asia Pacific Network Information Centre). Virtual hosts and IP's are available only on a leasing agreement, and cannot be transferred when your account is finalised. No virtual host is to exceed one subdomain eg yourhost.yourdomain.com. However you are allowed one dash '-' in your host eg i-am.elite.com.

Use of our Servers
Web sites and shell accounts are to be used by the primary owner only. Customers are not permitted to resell, store, or give away web hosting services off of their web site to other parties, unless prior permission is granted. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

Unauthorized Use
hostshell.com will strongly react to any use or attempted use of an internet account or computer without the owner's authorization. Such attempts include tricking other people into releasing their passwords, password cracking, security hole scanning etc... Any unauthorized use of accounts or computers by a hostshell.com customer, whether or not the attacked account or computer belongs to hostshell.com, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, according to the seriousness of the attack.

Payment Policy
All accounts are set up on a pre-pay basis. Setup fees are charged for all new accounts that are paid on a monthly basis and major account changes and are non-refundable. All pricing is guaranteed for the term of prepayment. hostshell.com reserves the right to change prices at any time. Payment is due each anniversary month or period following the date the account was established. If 2 days have passed and payment has not been posted, the account will be suspended until further notice. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies hostshell.com to request termination of services. All payments must be made in AUD (Australian Dollar).

Cancellation
hostshell.com reserves the right to cancel a customers service at any time. If cancellation is caused by customers violation of these policies, then no refund is due. Customers may cancel service any time but no refund is due.

Lawfull Purpose
hostshell.com reserves the right to refuse service to anyone. Customers may only use hostshell.com's servers for lawful purposes. Transmission of any material in violation of any federal, state or local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. hostshell.com expressly forbids anyone from using hostshell.com servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, satanic materials. The designation of any materials as such described above is left entirely to the discretion of the hostshell.com management.

hostshell.com is intended for the end user only. Customers cannot sublease, subhost, or give away control of any portion of hosthsell.com resources. Doing so could result in immediate account cancellation.

Indemnification
Customer agrees that it shall defend, indemnify, save and hold hostshell.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against hostshell.com, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless hostshell.com against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with hostshell.com's servers; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from hostshell.com's servers.

Disclaimer
hostshell.com will not be responsible for any damages your business may suffer. hostshell.com makes no warranties of any kind, expressed or implied for services we provide. hostshell.com disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by hostshell.com and its employees. hostshell.com reserves the right to revise its policies at any time.
